Message-ID: <004801c5528c$e3c49ee0$210110ac@jammerxp> The US Court of Appeals for the DC Circuit has unanimously ruled against the FCC and struck down the Broadcast Flag, which was supposed to go into effect on July 1st. The court said that "The FCC has no authority to regulate consumer electronic devices that can be used for receipt of wire or radio communication when those devices are not engaged in the process of radio or wire transmission." http://news.com.com/Court+says+FCCs+broadcast+flag+is+toast/2100-1030_3-5697719.html The text of the court ruling is at http://pacer.cadc.uscourts.gov/docs/common/opinions/200505/04-1037b.pdf ------------------------------ Date: Fri, 06 May 2005 19:27:59 -0400 From: Andrew Coutermarsh To: ytsejam@torchsong.com Subject: Re: Court strikes down Broadcast Flag! The court also made it clear that the FCC has no jurisdiction only in the way that Congress hasn't given it the jurisdiction. The next battle is going to be fought at the Capitol, and something tells me that given Congress's affinity toward corporations, they're going to easily cave to the whims of corporate broadcasters and GIVE the FCC the ability to do this. *Andrew Coutermarsh* http://www.acvox.com/ /*andrew* at *acvox* dot *com*/ JM Souter wrote: >The US Court of Appeals for the DC Circuit has unanimously ruled against the >FCC and struck down the Broadcast Flag, which was supposed to go into effect >on July 1st.
