Here's what former "Bass Player" magazine editor Jim Roberts had to say on the subject when it came up in his magazine in November of 1996: "Over the last few months, I've gotten quite a bit of mail from readers who have been scrutinizing the small print on our Giveaway pages. (Nothing gets by you folks, does it?) The line that's caused the most consternation is the one that reads: "This Giveaway is open to all legal residents of the United States and Canada, except residents of the province of Quebec . . . ." How come, I've been asked, almost all of our foreign readers are excluded from participating? And why are we picking on the residents of Quebec, home to many loyal BP readers? The answer is simple: We must do this to comply with the law. Most countries have strict rules about the ways in which raffles and contests may be conducted. As if that weren't bad enough, many states and provinces (or their equivalents) have additional rules. This legal maze was erected to protect the participants from crooks who want to take the money and run. This is a good thing -- no one wants to let ripoff artists run wild -- but it also means we cannot automatically include all readers in our Giveaways. After a contest that appeared in Guitar Player nearly ran afoul of the laws in Florida, our corporate lawyers were told to examine the way our Giveaways have been presented and to make sure the rules were correct. They advised us that to comply with the laws in every jurisdiction where our readers live would require a tremendous expenditure of time and money. Changes were made so we meet the rules where the vast majority of our readers reside, and we were given a new set of rules to print. The situation in Quebec is particularly unfortunate, and I have been bombarded with mail accusing us of prejudice (or worse). I requested a written explanation of the problem and received a lengthy letter explaining the procedures required by the Regie des Lotteries, which is the governing body that regulates games of chance in Quebec. These rules are daunting; they include a complex procedure for the posting of a bond (which guarantees the prize will be awarded in the value specified) and the requirement that we publish all advertisements, rules, and entry forms in French as well as English. These restrictions are considerably more difficult to comply with than those of the United States and the other Canadian provinces, and our lawyers concluded that making the residents of Quebec eligible would "increase the expense of administering each Giveaway as well as most likely delay the publication schedule." We just can't do that -- so Quebec is out. Since BASS PLAYER is a worldwide publication, I'm not at all happy with these exclusions. I'd like to make our Giveaways open to all readers in all countries, but that's simply not possible right now. I just managed to get Journey out.. ;) , Warner Brothers an American company, JP an American citizen, etc... it's not as if you have a "right" to enter.
