That's roughly what's happening with a massive price-fixing s ettlement involving states and compact disc companies. The deal calls for payments of as much as $20 for customers who bought CDs between 1995 and 2000. But so far, only a few people have signed up, and officials fear the money will go begging. In September, the five top U.S. distributors of compact discs and three large music retailers agreed to pay $143 million in cash and CDs to settle allegations they cheated consumers by fixing prices. The lawsuit alleged that the companies - upset with low prices charged by some stores - conspired with retailers to set music prices at a minimum level, effectively raising the retail prices consumers paid for CDs. Part of the settlement - about $44 million in cash - is earmarked to pay customers from $5 to $20, depending on how many people wind up dividing the money. By the end of December, only about 30,000 people nationwide had applied for a piece of the pie, a tiny fraction of the number the settlement could handle. "The response thus far has been fairly abysmal," said Washington Attorney General Christine Gregoire, who's been on morning radio shows to promote the settlement. Gregoire was among the attorneys general of 41 states and commonwealths who accused record companies of conspiring with music distributors to boost the prices of CDs between 1995 and 2000. The companies settled rather than wage a costly legal battle. The settlement's Web site has been up for a month, and legal notices have been published in TV Guide, Parade and other national magazines, but the response rate has been very low, said Tina Kondo, a senior assistant attorney general in Gregoire's office. "I guess people don't like to read legal notices," Kondo said. Gregoire and other officials hope a radio advertising campaign set to launch soon will boost interest in the settlement. Anyone who bought a CD, cassette tape or vinyl record at a retail store between 1995 and 2000 is eligible. The application window closes March 3. You don't even need a receipt to prove you bought CDs by Hole, Metallica or Shania Twain in 1998. Just click to the settlement's Web site, answer three questions and fill in your name and address. But don't try to recoup the entire cost of your music collection - only one claim per customer. While 41 states took on the music companies, consumers in all 50 states are eligible for the cash. There is one catch. If more than about 8.8 million people apply, in which case the per-person share would drop below $5, the customer part of the settlement is to be canceled because sending out such small checks would be too expensive. Instead, the money will go to public entities and nonprofit organizations in each state to promote music programs. The settlement already calls for those organizations to receive 5.5 million CDs valued at $75.7 million. The music distributors participating in the deal are Bertelsmann Music Group, EMI Music Distribution, Warner-Elektra-Atlantic Corp., Sony Music Entertainment and Universal Music Group. Also included in the deal were three national retail chains: Trans World Entertainment, Tower Records and Musicland Stores, a division of Best Buy Co. Inc. It really didn't seem to rise above the rest at all. Big disappointment for me, after Hypothetical. As you can imagine, I am now going to heartily recommend this disc. It was tops for 2001 (that was the year it was released, right?) IMO. Absolutely killer. On CM they kind of took that same sound, but without the energy... sad. I love Mac's voice though, and they put on a great show live. They won over quite a few new fans at ProgPower. Wounded Land is okay, I've just never really gotten into it as much as Extinct Instinct or Hypothetical. Just in case some of you, like me, were thinking 'Hey, why don't I use that $20 to go out and buy the new Porcupine Tree CD' or something similar, may I suggest that instead of giving the money right back to the organization that extorted it from you in the first place, you give the money to an organization that can help prevent this kind of conspiracy in the future as well as fight the other loads of anticonsumer nonsense the RIAA and MPAA have been strongarming into law in the last few years. It is a very good cd, highly recommended. Their sound is somewhat reminiscent of Fates Warning duiring their No Exit / Perfect Symmetry era, mixed in mith some fusion elements. I don't hear much difference in their sound throughout the albums, so I don't know with which others of their albums I would group it. Luca Turilli's two solo albums are must buys as well if you're into Rhapsody's style. Just as good as Rhapsody, and very similar in style to Rhapsody. > 6. Is the new Meshuggah any good? Don't know much about Meshuggah, but what I have heard has sounded pretty boring to me. BUT, I do have their guitarist's solo album, Fredrick Thordendal's Special Defects, and it kicks ass. It's wackier than Meshuggah and incorporates a lot of jazz fusion stuff in the music. The new one in general has slightly more groove than Chaosphere with the highlight to me being Nothing... but Chaosphere is just noise... too much science and not enough music... -The Doc ------------------ I, on the other hand, consider "Chaosphere" to be the best extreme music release of the last decade. The absolute high point of heaviness. Laced with solo guitar inspired by Allan Holdsworth, the complexity of this album, most of which you will not even notice until after repeating listening, beggars belief. I must've listened to this a hundred times, and I still only "get" selected fragments of songs. The rhythms are so complex as to be in the category of Zappa's "Black Page" all over the album. Curiously, most metal fans do not seem to be able to really appreciate this album. Most metal fans say that it is dull and monotonic. On the surface, that may even be true, because this album is at the same level of brutality throughout - there isn't a moment of release, it's all just plodding riffs and rhythms that are seemingly variations of 4/4. However, closer listening reveals that there are mostly 2, 3, or 4 rhythms going on at the same time, with only one of them keeping a straight 4/4, while for example the guitars are in 5/4 and the drums are in 6/4 *at the same time*. That album is loaded with incredible musicians playing unbelievable stuff in addition to the humorous lyrics. Musicians include Jack Bruce, Jean-Luc Ponty, Aynsley Dunbar, George Duke and Ruth and Ian Underwood! "Hot Rats" would be another good one for a more progressive effort, including "Peaches en Regalia" and some long tracks with more of Frank's guitar work. "Jazz From Hell" is just plain SICK! "Tinsel Town Rebellion" is mostly live and has Steve Vai on it 'nuff said! I'd forgotten how many albums he had! If you go to Rykodisc.com you can order the intire 61 CD catalog for a mere $950! Mac is great and all 3 albums that he appears on are amazing, Hypothetical, Clone and the aforementioned Critical Mass. Damian Wilson was on 2 releases (not successive however): Wounded Land and Extinct Instinct. Wounded Land is a classic, while Extinct Instinct is my least favorite Threshold album, boarding on weak! In between those 2 releases, they put out my favorite Threshold album called Psychedelicatessen (along with a live EP) with my favorite singer Glynn Morgan. InsideOut released these 2 together recently as a double CD. This was the CD that got me into them way back in 1994! Buy this one for sure! Hope that helped.
