I'll repeat the name for you all - FLATSTICK. What do they sound like? Imagine making cocktails by putting Pantera, Frank Zappa and Meshuggah into your shaker - this is the basis for your drinks. Then, depending on what you want each song to sound like, add extracts of punk rock, Waltari, techno, latino beats, Fear Factory. Polyrhythms abound, lots of shred, very strange song structures, wonderful lyrics about Asian girls having their clitty pierced. The musicianship is astonishing. Been doing that a lot lately, since I got a job. Anyway, I saw an album by a band called Tunnelvision, remembered hearing something about them and bought the album. Holy Gsus fuck! It's amazing! IMHO even better than Dali's Dilemma (and I think they're magnificent). The album is called "While the World Awaits" and it contains 11 tracks, with lengths ranging from 1:49 to 7:05. The band's lineup is Marko Waara (vocals, recommended to the band by Timo Kotipelto of Stratovarius and has an excellent voice), Juhani Malmberg (guitars), Lauri Porra (bass), Kari Tornack (organ and synthesizers) and Mirka Rantanen (drums). The music is sort of Stratovarius meets Kamelot meet Vanden Plas meets Dream Theater (or something like that.. =) You can find more info, as well as some sound samples on their homepage, http://www.tunnelvision.org BTW. I just got a hold of the CD from a friend and listened to it - it's REALLY beautiful; it actually (to my ears) sounds a lot like Eve. And it was it classified as such to name the list teh most popular songs in all the land. The old defintion is pretty much now defunct. At any rate, I am really looking forward to the Electric Factory show next month. It's great that they're opening the tour there so that the setlist should be a complete suprise when I go see them. I'm thinking they'll do 4 or 5 songs from SFAM and lots of older stuff as well. Every band's name is protected by what's called a service mark (which is just a trademark for the entertainment service that you provide). It basically means that the public associates that name with your band and your band alone. As soon as you start using the name (like playing around town, etc), that's when that association begins. With a service mark, you can not only stop somebody from using your name, you can stop somebody from using a name that is similar enough to yours to cause confusion (meaning you couldn't name your band Metallican or The Mootey Bluez without getting a meancing, legal-looking letter in the mail). In the case of the Id that was around in the '70s, I would advise researching to see how successful they were in terms of album sales, chart positions, etc. Where they a national act or a local band playing the South Carolina circuit? How long ago did they break up? Is there anybody still laying claim to the name (as in "Appearing Tonight: Bill Pill, Former Fiddle Player For Id")? If they released albums on a major label (or possibly even on an independent), they will have registered for a federal service mark, which is renewable incriments of 10 years. If it's been a while since the name has seen any significant action, meaning there have been three consecutive years of non-use of the name and there is no "residual reputation" from that band's existence (the Beatles broke up decades ago, but no one would be stupid enough to try to grab that name), chances are they will have let the renewal period pass and have therefore opened up the name for the taking. If not, you have two choices: pay the owner of the name a lump some in exchange for its ownership or change the name. Whatever name you choose, you should register for a Federal Actual Use Service Mark (if you're going to be sellling CDs over the internet like I think you will, you will be conducting interstate commerce and thus falling under federal, not local, jurisdiction...the same is true if you've been performing in bars that are likely to attract interstate patrons, which on the East Coast is pretty much a given) with the United States Patent And Trade Office. Or you can file an Intent To Use form. You can get the right form from their website, www.uspto.gov. The cost of this registration process is, last I checked, $245 (for actual use), a small price to pay given the legal action that could be taken against you. Because I can guarantee you that even the members of the original Id haven't played a note since 1971, they will come out of the woodwork if your album is a success and you haven't covered your ass. They might not win their case against you, but they will cause you unnecessary legal fees and considerable aches, making that $245 look like putting a quarter in the parking meter to avoid a $40.00 ticket. Along with the fee you will be asked to submit proof that you actually used the name (an advertisement the club took out with your name in a paper likely tp cross state lines, a band flyer with the club address, etc.) But before you do that, I suggest you make sure that there are no other "Ids" floating around so you don't get sued for infringing on somebody else's service mark. You can do this by checking the USPTO website address I gave you above, but bare in mind that the website always lags three months behind the Office's actual records. If you find there is currently a band called Id that does the South Carolina Bar Mitzvah circuit, even if they have a federal service mark, you could probably attain one too, so long as both groups agree not to perform as "Id" in the other's respective territory. Since you're probably planning to sell CDs over the internet, that means they could throw up a stink if you're selling CDs as Id in South Carolina, just like you could if they were playing your cousin's Bar Mitzvah in Long Island. If that's the case, it's best that one of you simply choose another name. Feel free to drop me a line with any questions you may have. Many will give a free consultation where they will give you a quote as to how much they charge for handling all this crap for you, as well as giving a more knowledgable explanation about this whole process. The only other Metallica album I had at the time was "Justice," so I pretty much liked everything on "Black." The hardcore Metallica fans around me were unanimous - "Sad But True" and "Of Wolf And Man" were the only good songs, the rest of the album was a weak-riff festival. "You LIKE that sandman song?
