It's only considered stealing if there's a certain amount of time of something (like I think in the law it says if there is a certain number of notes from a melody or something like that), otherwise it's just a quotation of something else. It's not a breach of copyright because he only used a tiny portion of the theme. You'll notice that neither the Star Wars quotation nor the Close Encounters quotation were in the credits, yet the Free Bird, Enter Sandman, and Have a CIgar references WERE creditted in the liner notes. This is because there was so much of the song taken that they had to give credit and, in all likelihood, pay royalties on those songs. I met Jaco's tech a few times when I lived in South Florida, as well
as musicians that had played/partied with him and were in the scene
at the time. I've heard a fair amount of stories, and Jaco may have
been a royal pain in the ass at times, but he was no Ricardo Testa.
Mr Testa, I know you certainly don't NEED and other musicians, but if
for the sake of experimentation you want a few guys to play on your
5th opus, may I suggest God on keys, and the combo of Krishna and
Buddha on bass and drums respectively. I know they aren't really your
caliber , but hey, they'd just be the backup band right? Oh, and you
might want to reconsider your stance on mp3's . After all, they are a
great way for UNKNOWN musicians to get exposure.

Anybody know of ways to get DT merch besides the shows? I'd like
the "suicide note" t and the hat also. Maybe this is the stuff Rena's
gonna sell? I hope DT maybe makes mugs and mousepads in the future. A

That's why I said "doesn't generally". :-) I also really love the "Dies Irae" section from Verdi's Requiem which is a great choral part (often played in movies during the really dramatic sections). It's amazing, especailly at high volume. :) I also really like Gorecki's 3rd Symphony and Wagner's "Siegfried's Funeral March" (used in Excalibur) among others. I was just trying to imply that I am a bigger fan of symphonic classical than of opera or choral pieces. Like most things for me, there are exceptions. Also, to the person who said that "the guy who wants a good foot tapping tune" wouldn't like the new King Crimson, I actually am a fan of KC, though not a huge one.
